SAGG LLC dba ZivTrack (“ZivTrack,” “Company,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, share, and safeguard your information when you use the ZivTrack mobile application, website, provider dashboards, and related services (collectively, the “Service”).

By creating an account, downloading the application, or using the Service, you agree to this Privacy Policy. If you do not agree, you should not use ZivTrack.

  1. Information We Collect

We may collect the following types of information:

a.Account Information

  • Name, email address, phone number, username, and password.

  • Billing and payment details when you purchase subscriptions.

b.User and Professional Content

  • Information you voluntarily provide, including daily check-ins, responses, notes, and any documents or files uploaded to the Service.

  • Content created by professionals or providers you are connected with, such as questions assigned to you, feedback, and messages sent through the Service.

  • Messages and communications exchanged between you and ZivTrack (e.g., support inquiries, in-app chat, or responses to surveys).

c.Derived Data

  • Analytical information generated from your use of the Service, such as scores, averages, progress tracking, and trend reports.

  • This derived data is used to provide insights to you (and to providers, if applicable) and to improve the Service.

d.Device & Technical Data

  • Device type, operating system, browser type, IP address, app version, crash reports, and log data.

e.Health-Related Data

  • Information you voluntarily provide that may relate to your mental health, well-being, or physical condition.

  • Direct-to-consumer users: This data is not governed by HIPAA but is protected by this Privacy Policy.

  • Healthcare provider–linked users: When used through a licensed provider, this data may be “protected health information” (PHI) and will be handled in accordance with HIPAA and our Business Associate Agreement (BAA) with that provider.

  1. How We Use Your Information

We use your information to:

  • Provide and operate the Service.

  • Facilitate check-ins, dashboards, and reporting features.

  • Process payments and manage subscriptions.

  • Communicate with you about your account, support requests, or updates.

  • Generate and share scores, averages, and trend insights.

  • Improve and personalize the Service.

  • Ensure security, prevent fraud, and comply with legal obligations.

  • Where permitted, send promotional communications (you may opt out at any time).

  1. How We Share Your Information

We do not sell your personal data. We may share your information as follows:

  • With Service Providers: Vendors such as Microsoft (hosting) who help us deliver the Service under strict data protection agreements.

  • With Healthcare Providers: If your account is connected to a provider, your check-ins, notes, and derived data (scores/averages/trends) may be shared with them.

  • For Legal Reasons: When required to comply with applicable law, regulation, legal process, or government request.

  • Business Transfers: If ZivTrack is involved in a merger, acquisition, or sale of assets, your information may be transferred.

  1. HIPAA Applicability

  • Direct-to-consumer users: ZivTrack is not a “covered entity” under HIPAA. Your use is governed by this Privacy Policy and applicable privacy laws.

  • Provider-linked users: When ZivTrack is used by or on behalf of a licensed provider, we act as a “Business Associate” under HIPAA, and our use of PHI is governed by a signed BAA with that provider

We implement reasonable administrative, technical, and physical safeguards, including:

  • Encryption in transit and at rest.

  • Access controls and role-based permissions.

  • Regular system monitoring and backups.

If we become aware of a data breach affecting your personal information or PHI, we will notify you in accordance with applicable laws (including HIPAA breach notification requirements where applicable).

  1. Data Retention

We retain your information as long as necessary to provide the Service and meet legal obligations. You may request deletion of your account and data (see Section 7). For provider-linked users, retention may also be subject to provider or legal recordkeeping requirements.

  1. Your Rights

Depending on your location, you may have the right to:

  • Access a copy of your personal data.

  • Request correction or deletion.

  • Export your data in a portable format.

  • Object to or restrict processing of your data.

  • Opt out of marketing communications.

  1. International Users

  • EU/UK (GDPR): You have rights to access, rectify, erase, restrict, and port your data. You also have the right to lodge a complaint with your data protection authority.

  • Canada (PIPEDA): You have rights to access and correct your personal data and to withdraw consent.

  • By using the Service, you acknowledge your information may be transferred to and processed in the United States.

  1. Children’s Privacy

  • ZivTrack is not directed to children under 13, and we do not knowingly collect personal information from them.

  • Users under 18 may only use the Service with guardian consent or through a provider. If we discover information collected from a child under 13, we will delete it.

  1. Changes to this Policy

We may update this Privacy Policy from time to time. If changes are material, we will notify you by email or in-app notification before they take effect.
